SMS Terms and Privacy Statement

These SMS Terms and Conditions and Privacy Policy apply to one-to-one text-message communications provided by Havens of Minnesota LLC (“Havens of Minnesota,” “we,” “our,” or “us”).

SMS Terms and Conditions

1. SMS program description

Havens of Minnesota LLC permits adults who are current clients, former clients, prospective clients, or seeking information about services to communicate directly with individual employees through SMS text messaging. Individuals may initiate SMS conversations directly. Employees may also initiate SMS communication with current clients who have provided prior written SMS consent during service initiation.

Messages may concern:

  • Information about available services
  • Appointment scheduling, confirmation, or rescheduling
  • Attendance and administrative follow-up
  • Follow-up after an unexpected absence
  • Requests for telephone calls
  • General care coordination
  • Responses to questions initiated by the individual
  • Other limited communications related to the individual’s services

This SMS program is intended for low-volume, manual, one-to-one conversational communication. Havens of Minnesota LLC does not use this program for advertising, marketing, promotional messaging, bulk messaging, automated alerts, or API-driven communication.

2. How SMS consent is obtained

Havens of Minnesota LLC obtains voluntary SMS consent through two methods.

First, an individual may initiate SMS contact by texting an employee at a telephone number obtained through an existing professional relationship, previous telephone communication, caller identification, a business card, written correspondence, or another direct interaction with the employee. By initiating SMS contact, the individual requests SMS communication and consents to receive one-to-one conversational replies related to the individual’s inquiry or services.

Second, during service initiation, each client receives the Havens of Minnesota LLC Client Handbook containing the complete SMS Policy. Staff explain the policy and provide the client with an opportunity to ask questions. The service-initiation form contains a separate line labeled “SMS Text Messaging Opt-In Consent (Optional).” Clients who voluntarily consent place their initials beside that line. Clients who do not consent leave the line blank.

SMS consent is optional, is not required to complete service initiation, and is not a condition of receiving treatment or other services. The signed and dated service-initiation form is retained as evidence of consent.

3. Consent to receive SMS messages

By initiating SMS contact with a Havens of Minnesota LLC employee, you consent to receive one-to-one conversational replies concerning services, scheduling, appointments, attendance, administrative questions, care coordination, requested telephone contact, or the subject of your inquiry.

By initialing the optional SMS consent line during service initiation, you consent to receive manual, one-to-one SMS messages initiated by individual Havens of Minnesota LLC employees. These messages may concern services, scheduling, appointments, attendance, unexpected absences, care coordination, requested telephone contact, or administrative matters.

SMS consent is optional and is not a condition of receiving treatment or other services from Havens of Minnesota LLC. You may choose to communicate by telephone or another available method instead. You may withdraw SMS consent at any time by replying STOP.

By initiating an SMS conversation, initialing the optional SMS consent line, or continuing a conversation after receiving the initial SMS disclosure, you agree to these SMS Terms and Conditions and acknowledge the SMS Privacy Policy.

4. Message frequency

Message frequency varies based on the nature of your inquiry, appointments or services, and your participation in the conversation. Havens of Minnesota LLC does not send recurring marketing or promotional messages through this program.

5. Message and data rates

Havens of Minnesota LLC does not charge you for its SMS service. Message and data rates may apply according to your mobile telephone plan. Your wireless carrier is responsible for any charges assessed under your plan.

6. Opting out

You may withdraw consent and stop SMS communication at any time by replying with any of the following:

  • STOP
  • QUIT
  • END
  • REVOKE
  • OPT OUT
  • CANCEL
  • UNSUBSCRIBE

After you opt out, you may receive one final message confirming that your opt-out request has been processed and that no further text messages will be sent from that number.

Havens of Minnesota LLC will not send further SMS messages from that number unless you subsequently reply START, independently initiate a new SMS conversation, or otherwise provide new consent.

Havens of Minnesota LLC will not attempt to avoid an opt-out request by contacting you from another employee’s number. SMS communication from a different Havens of Minnesota LLC number will occur only if you independently initiate that communication or provide new consent.

Opting out of SMS does not prevent Havens of Minnesota LLC from contacting you by telephone, voicemail, mail, email, or another authorized method when appropriate.

8. Emergencies and urgent concerns

SMS is not an emergency or crisis service and may not be monitored continuously. Do not use SMS to report an emergency, request immediate clinical assistance, or communicate an urgent safety concern.

Call 911 if you are experiencing an emergency. Call or text 988 to reach the Suicide & Crisis Lifeline.

9. Privacy and security risks

SMS text messaging is not guaranteed to be encrypted, secure, or confidential at every stage of transmission or storage.

Messages may appear on your device’s lock screen or notifications. They may be accessible to anyone with access to your telephone, mobile account, shared devices, or device backups. Sending or receiving a message from Havens of Minnesota LLC may reveal that you are communicating with a substance use disorder treatment provider.

By choosing SMS communication, you:

  • Request that Havens of Minnesota LLC communicate with you through SMS
  • Acknowledge the privacy and security risks associated with SMS
  • Consent to receiving manual, one-to-one conversational SMS messages
  • Accept the risk that an unauthorized person could view messages stored on or transmitted to your device

Your consent authorizes Havens of Minnesota LLC to use SMS as a communication method. It does not waive rights provided by the Health Insurance Portability and Accountability Act, 42 CFR Part 2, the Minnesota Health Records Act, or other applicable privacy and confidentiality laws. It does not authorize Havens of Minnesota LLC to use or disclose information in a manner otherwise prohibited by law.

Havens of Minnesota LLC applies reasonable safeguards and attempts to limit SMS communications to the minimum information reasonably necessary for the conversation.

Do not use SMS to send detailed clinical histories, treatment records, medication information, Social Security numbers, insurance information, financial information, or other highly sensitive information.

An employee may decline to discuss a sensitive matter through SMS and may ask to continue the conversation by telephone, secure electronic communication, telehealth, or in person.

10. Availability and message delivery

Delivery of SMS messages depends on cellular networks, mobile carriers, Microsoft Teams, and other systems outside the control of Havens of Minnesota LLC. Messages may be delayed, blocked, misdirected, or not delivered.

Havens of Minnesota LLC does not guarantee uninterrupted, timely, secure, or error-free SMS service. Mobile carriers are not responsible for delayed or undelivered messages.

11. Changes to these terms

Havens of Minnesota LLC may revise these SMS Terms and Conditions when its practices, services, or legal obligations change. The updated version will be posted on this webpage with a revised effective date.


SMS Privacy Policy

1. Information collected through SMS

When you communicate with Havens of Minnesota LLC by SMS, or provide written consent to receive SMS messages, we may collect or maintain:

  • Your mobile telephone number
  • Your name or the identity associated with the conversation
  • The content of messages sent and received
  • The date and time of messages
  • Message-delivery information
  • Opt-in, opt-out, HELP, and consent records
  • Information needed to respond to your inquiry or coordinate services

Depending on the content of the conversation and your relationship with Havens of Minnesota LLC, SMS communications may contain personal information, protected health information, or substance use disorder treatment information.

2. How SMS information is used

Havens of Minnesota LLC may use SMS information to:

  • Respond to your messages
  • Provide information about services
  • Schedule, confirm, or reschedule appointments
  • Address attendance or administrative matters
  • Follow up after an unexpected absence
  • Coordinate services or respond to requests
  • Arrange telephone or other communication
  • Maintain appropriate business or clinical records
  • Document consent, opt-out requests, and communication history
  • Protect the safety, security, and legal rights of Havens of Minnesota LLC and others
  • Comply with applicable legal and regulatory requirements

Havens of Minnesota LLC does not use SMS information for unrelated advertising, marketing, or promotional campaigns.

3. Mobile information and data sharing

Havens of Minnesota LLC does not sell, rent, or share mobile telephone numbers, SMS opt-in information, or SMS consent information with third parties or affiliates for marketing or promotional purposes.

Text-message originator opt-in data and consent information will not be shared with third parties or affiliates for their own marketing or promotional purposes.

SMS information may be transmitted through or processed by Microsoft, mobile telephone carriers, telecommunications providers, and vendors that support message delivery, information technology, security, recordkeeping, or legal compliance. These service providers may process information only as necessary to provide services to Havens of Minnesota LLC and may not use SMS information for their own marketing or promotional purposes.

Havens of Minnesota LLC may disclose information when authorized by the individual or when permitted or required by applicable law. Protected health information and substance use disorder treatment information remain subject to applicable federal and state confidentiality requirements.

4. Security and confidentiality

Havens of Minnesota LLC uses reasonable administrative, technical, and physical safeguards to protect information under its control. However, ordinary SMS communication is not guaranteed to be encrypted, secure, or confidential at every stage of transmission or storage.

Messages may be transmitted through or stored by Microsoft, mobile telephone carriers, telecommunications providers, your device, device backups, and other systems outside the direct control of Havens of Minnesota LLC.

Anyone with access to your telephone, notifications, mobile account, shared devices, or backups may be able to view your messages.

When applicable, Havens of Minnesota LLC protects information communicated through SMS in accordance with HIPAA, 42 CFR Part 2, the Minnesota Health Records Act, and other applicable confidentiality requirements.

Choosing to communicate by SMS does not waive these protections or authorize disclosures that would otherwise be prohibited. Havens of Minnesota LLC may redirect sensitive or clinically detailed conversations to a more appropriate communication method.

5. Retention

Havens of Minnesota LLC may retain SMS communications according to its record-retention practices and applicable legal, regulatory, contractual, clinical, or business requirements.

Written SMS consent, HELP, and opt-out records may be retained to document and honor communication preferences. Applicable communications may be incorporated into an appropriate clinical or business record.

6. Your choices

You are not required to communicate with Havens of Minnesota LLC through SMS. You may request communication by telephone or another available method.

You may withdraw consent to SMS communication at any time by replying STOP. Withdrawing consent will not affect your eligibility for or receipt of services from Havens of Minnesota LLC.

7. Relationship to other privacy notices

This SMS Privacy Policy supplements other privacy notices issued by Havens of Minnesota LLC, including any Notice of Privacy Practices provided in connection with treatment services.

This policy does not replace or reduce privacy or confidentiality protections that otherwise apply under HIPAA, 42 CFR Part 2, the Minnesota Health Records Act, or other applicable law.

8. Changes to this Privacy Policy

Havens of Minnesota LLC may revise this SMS Privacy Policy when its practices, services, or legal obligations change. The updated version will be posted on this webpage with a revised effective date.
